The new state law permits the District to waive a volunteer’s need to obtain the Act 114 Criminal History Record Check that requires fingerprinting if:
- The volunteer has been a resident of the Commonwealth of PA for the entirety of the previous 10 years AND
- Has never been convicted of a Disqualifying Offense as listed in Policy 916.
A waiver is also permitted if:
- The volunteer has not been a resident of the Commonwealth of PA for the entirety of the previous ten (10) years but has received a favorable Federal Criminal History Record Check at any time since establishing residency in this Commonwealth and:
- Submits a copy of the FBI certification; AND
- Submits a sworn affidavit (in the form of the Volunteer Request for Waiver of FBI – Federal Criminal History Record Check) that the volunteer has not been convicted of a Disqualifying Offense in PA or any other state or jurisdiction, including foreign jurisdictions after the date of the FBI certification
If you qualify for a Waiver, you will be required to fill out the Volunteer Request for Waiver of 114 Criminal History Fingerprint Record Check below and submit it with both of the PA Clearances to the District Administration Offices.
